Bs of December 1, 2001, Maryland's Department of the Environment (MDE) lost the authority to issue Part 70 Operating Permits under Title V of the Clean Air Act. In its place, MDE will have to implement 40 CFR Part 71, the federal version of the Title V Operating Permit Program. EPA was forced, by law and lawsuit, to step in when the Maryland Legislature failed to provide MDE with federally acceptable judicial standing requirements. These new sources will be required to submit new, updated Part 71 permit applications, which will probably have to include Compliance Assurance Monitoring (CAM).
